A “passionate” lifelong West Tigers fan has been convicted and fined for making racist slurs against South Sydney Rabbitohs and NSW Origin star Latrell Mitchell.
Daniel Robert Hudson, of Lake Munmorah, faced Wyong Local Court on Friday after pleading guilty to one count of using a carriage service to menace, harass and offend.
The court heard that on April 17, following the South Sydney vs West Tigers game, Hudson sent a message to Mitchell’s Instagram account saying “enjoy your time on the sidelines you dirty abo. You should have been sent off twice tonight, when are you gunna clean up ya act and not play like a dirty c**t”.
The unemployed 25-year-old, who still lives with his parents, had a second count of using a carriage service to menace, harass and offend withdrawn and dismissed.
An agreed set of facts states Mitchell was involved in “a number of on-field incidents during a game against the Wests Tigers” on April 17.
“There was no action taken against the victim much to the displeasure of Wests Tigers supporters,” the facts read.
Mitchell was later banned for four weeks by the NRL judiciary for a dangerous elbow on Wests Tigers winger David Nofoaluma.
At 8.31pm on April 17, Hudson sent his first message to Mitchell’s Instagram account calling him an “abo” and “dirty c**t”.
The next day at around 7pm, he sent another message to Mitchell’s account saying “have fun on the sidelines ya grub”.
Just over an hour later, he sent “You’re a grub Latrell I’d bash you … word”.
The facts stated that Mitchell was “deeply offended” by the messages and did not reply but reported the matter to the NRL and South Sydney Football Club.
On April 20, he gave a statement to police and the Fixated Persons Investigation Unit identified Hudson through his Instagram account.
Late on April 23, police went to Hudson’s house in Lake Munmorah and conducted a search, seizing a mobile phone and laptop.
The facts state Hudson admitted sending the messages and did it out of “frustration” from the incidents during the game but he said he was not racist and “regrets sending the offensive messages”.
Hudson was convicted and fined $400.
Another man was also arrested by officers from the Fixated Persons Investigation Unit and charged with sending racially abusive messages to Mitchell.
Patrick James Hawkes, 22, pleaded guilty using a carriage service to menace, harass or offend when he first appeared in Taree Local Court on May 18.
Hawkes, of Taree, was later convicted and fined $750.
