Killarney Vale: One punch accused Riley Dalziell sentenced for drink-driving

A teenager who was on bail for allegedly coward-punching a 16-year-old, created a “dust storm” doing burnouts while drink-driving, a court has heard.

A magistrate has blasted an 18-year-old P-plate driver for a “stupid mistake” when he was caught doing burnouts next to a busy shopping centre just months after being charged with the alleged one-punch assault of another teenager.

Riley Dalziell appeared at Wyong Local Court on Tuesday where his lawyer entered guilty pleas on his behalf to mid-range drink-driving, failing to display P-plates and doing a burnout.

The court heard Mr Dalziell, of The Entrance, was on bail at the time having been charged with causing grievous bodily harm with intent to a 16-year-old following an incident at Killarney Vale on October 30 last year.

An agreed set of facts states police noticed a “dust storm” over a vacant block next to Bateau Bay Square shopping centre at 4.10pm on Australia Day, January 26, this year.

“Police then saw a dark blue roof of a motor vehicle spinning around in circles in what police would describe as a doughnut, the driving wheels of the vehicle lost traction,” the facts state.

Police activated their lights and sirens and stopped the dark blue Toyota Corolla near the exit in a fence towards Bay Village Rd.

The facts state officers noticed the car was covered in dust and asked Mr Dalziell for his identification and he produced his P1 licence.

He was breath tested at the scene and returned a positive reading before he was taken to Wyong Police Station where he later recorded a blood alcohol reading of 0.093.

He told officers he had consumed four Byron Bay Brew beers between 10am and 2pm that day.

His lawyer said Mr Dalziell had benefited from the traffic offender’s program and spent one night in custody, which was a “salient lesson”, following his arrest.

He said Mr Dalziell was an apprentice plumber, employed by his father, and lived with his parents.

Magistrate Kirralee Perry described Mr Dalziell as “a danger” to himself and everyone else and warned him that he did not want to go back to custody.

“This was a stupid mistake,” Magistrate Perry said.

She convicted Mr Dalziell of the three offences, fined him a total of $1100 and disqualified him from driving for six months.

The court heard he had not entered a plea to the charge of causing grievous bodily harm with intent and that matter was adjourned to March 22 for further mention.

In documents tendered to court, police allege Mr Dalziell was at an address at Torres St, Killarney Vale, three months earlier on October 30 when a 16-year-old, accompanied by four or five other persons, attended the location.

Police allege the 16-year-old had gone to the address to collect his girlfriend when the two groups began “inciting to fight each other”.

As the two groups began to disperse, police will allege in court Mr Dalziel approached the 16-year-old from behind, called out to him and when the victim turned around Mr Dalziell punched him to the face.

The victim fell and hit his head on the roadway knocking him unconscious.

He underwent emergency surgery and remained in an induced coma for several days.

Mr Dalziell’s bail in that matter was continued and Magistrate Perry ordered the brief of evidence be served before the next court appearance.
