High range drink-drivers Jamie Richard Herbert, Christian John Smith Delagarde and Jasmine Lee Maude plead guilty

One man wrapped his car around a tree, another appeared to have soiled himself while a serial offender was picked up for her fourth drink-driving charge as a trio of motorists plead guilty.

Three people have pleaded guilty to high range drink-driving in separate incidents as police urge motorists to take care on the roads following a spate of horror fatalities.

Two men and a woman — Jamie Richard Herbert, Christian John Smith Delagarde and Jasmine Lee Maude — were among dozens of drivers at Wyong Local Court on Monday charged with various offences.

Delagarde, 28, of Kanwal, returned a reading of 0.173 after his silver Subaru left the Pacific Highway at Kangy Angy at 1.25am on Saturday, August 12, and ploughed head-on into a large gum tree.

Another passing motorist saw Delagarde crawling out of the passengers side door because the driver’s door was jammed shut.

The other driver rang triple 0 as Delagarde drifted in and out of consciousness.

He was taken to John Hunter Hospital where a blood sample was taken and later returned a reading approaching four times the legal limit.

He presented to Wyong Police Station two days later with a fractured pelvis, shattered nose, bruises, cuts, stitches in his chin and bleeding on the brain.

Delagarde told police he was with friends at Gosford before he “made a wrong decision and a stupid choice” to get behind the wheel, which he didn’t remember.

“I was drinking a bottle of tequila with my mates and a case of beer,” he told police.

He was convicted, fined $100 and disqualified for seven months with a further 24 months on an interlock order.

Herbert, 50, of Cranebrook near Penrith, was pulled over in his blue Mitsubishi Triton on the M1 motorway shortly after 9am on November 23 at Warnervale.

Police noticed a strong smell of alcohol coming from his breath.

“His eyes were slightly glazed and his pants were soiled. Police formed the opinion that the accused was well affected by alcohol,” an agreed set of facts states.

He failed a roadside test before being taken to Wyong Police Station where he also recorded a blood alcohol reading of 0.173 and told officers he had drunk 15 cans of XXXX Gold the night before.

He was adjourned to February 26 to undergo a sentencing assessment report.

Maude, of Wyongah, was also adjourned to undergo a sentence assessment report after the magistrate found it was the 41-year-old’s fourth time before the courts for drink-driving.

Magistrate Robert Munro said she returned a high range reading of 0.157 after she was pulled over shortly before 10pm on December 8 on the Pacific Highway at Hamlyn Terrace.

It came after she was convicted of two mid-range drink-driving offences in 2011 and 2012, and another high range in 2017.

Maude told police she had consumed three glasses of wine with dinner before getting behind the wheel.

It comes after five people died in three separate crashes on NSW roads within the space of about five hours on Monday with police appealing for all drivers to take care on the roads.
