Kane Nay Smith faces court after allegedly assaulting two police officers at Gosford

The man who allegedly left one police officer with a suspected fractured eye socket and another with a shoulder injury has faced court.

The man who allegedly injured two police officers during an arrest in Gosford overnight has been granted bail.

Kane Michael Nay Smith, of Berkeley Vale, faced Gosford Local Court on Wednesday following his arrest in the early hours of the morning.

The 47-year-old was wearing police-issued white coveralls for his court appearance, after being released from hospital.

Magistrate Elizabeth Ellis granted him bail with strict conditions which included him not entering the suburbs of Chittaway Bay or Gosford and living in Wyoming with family.

She told him “I don’t want you coming across any police until we sort out your mental health condition”.

Nay Smith is facing two charges of assaulting a police officer in the execution of duty and causing actual bodily harm as well as two counts of resisting an officer.

Police allege that Nay Smith assaulted the officers between 1.57am and 2.30am in Gosford.

Police were called to John Whiteway Drive after reports an intoxicated man was acting aggressively towards members of the public.

Brisbane Water Police District officers attended and stated they approached Nay Smith and attempted to arrest him. He allegedly became violent and punched the officers to the face and head.

One officer suffered a suspected fractured eye socket, and the other suffered an injury to his shoulder.

The man was placed under arrest by assisting police and was taken to Gosford Hospital for assessment. Both officers were taken to hospital for further treatment.

Nay Smith is also facing charges of assault occasioning actual bodily harm (domestic violence related) on a woman and intimidate police officer, from an incident on Tuesday afternoon in Chittaway Bay.

Nay Smith’s Legal-Aid solicitor told the court he “led a productive life" and held a senior role with the Roads and Maritime Services (RMS). He had a criminal record, with his last offences back in the 1990s.

The prosecution opposed bail, stating Nay Smith was an unacceptable risk to the victim from Tuesday and his alleged actions against the police officers were serious.

Magistrate Ellis transferred his matter to Wyong Local Court for his next appearance, saying “quite bluntly I am concerned as to the police at Gosford”.

Nay Smith will next appear on March 11.
