Glenning Valley: Undies sniffing dad pleads guilty to indecently assaulting daughter

A father-of-four will be sentenced in Gosford District Court for indecently assaulting his eldest daughter after his wife busted him sniffing “undies”.

A man has pleaded guilty to indecently assaulting his eldest daughter after his wife became suspicious when she caught him sniffing underwear.

The man, who cannot be named for legal reasons, faced Wyong Local Court on Tuesday where he formally entered guilty pleas to three counts of indecently assaulting a person under 16.

An agreed set of police facts, tendered in court, states the man was living with his wife and children at Glenning Valley in 2017.

Shortly after his daughter’s tenth birthday he entered her bedroom, laid down beside her and indecently assaulted her.

The facts state on a Friday or Saturday night not long after the first incident the victim was in her bed half asleep when he came in and indecently assaulted her again.

About a week later the victim was asleep when he entered her room and indecently assaulted her again, causing her to wake up.

“On the same night as the third incident, (his wife) saw the offender sniffing an item of underwear in the ensuite of their bedroom,” the facts state.

“The offender looked startled. She said to him `what are you doing?’ He replied `I’m sniffing your undies.’ She said `that’s f...ing disgusting’ and walked away.”

The man’s wife became concerned the underwear was not hers so she decided to put a load of washing on and discovered the underwear belonged to their daughter.

On the morning after the third incident the victim went into her parent’s bedroom after her father had left for work.

The facts state the girl’s mum asked her ”has anyone ever touched you inappropriately?”.

The girl replied “yes” and her mum asked “who?”. The girl said “dad”.

The girls’ mum told her sister and mother-in-law before going to his workplace to confront him.

The police facts state she asked him if he had been touching their daughter and he said “no”.

“From the look on his face (his wife) believed he was lying,” the facts state.

She later went to her parents-in-law’s home where her husband was present.

“The offender was visibly upset and crying. He said, `I did it’,” the facts state.

The girl’s mum asked if she wanted to talk to anyone about it but she was too embarrassed.

The facts state for the next 12 months the girl then regularly asked her mum when her dad was going to be moving out.

On June 17, 2020 the Central Coast Child Abuse Unit received a mandatory reporting notification regarding the victim.

She attended on June 18 and participated in an electronically recorded interview where she disclosed the three incidents.

At 4.50pm that afternoon the man attended Wyong Police Station but declined to be interviewed and he was subsequently charged.

The man will face Gosford District Court next month to set a date for sentencing.
