Two young men who carried out an alleged violent sexual assault on a woman in Mardi will go to trial.
Caleb Galey-Newbury, of Charmhaven, and Jayden Paulley, of Mardi, appeared at Wyong Local Court on Tuesday where they both entered pleas of not guilty to charges relating to the alleged sexual assault in November 2021.
Galey-Newbury, 23, sat in court alone, while Paulley, 24, was supported by his mother. Both men were wearing suits and did not look at or talk to each other.
Galey-Newbury’s defence lawyer entered pleas of not guilty to charges of aggravated sexual assault in company inflicting actual bodily harm, two counts of aggravated sexual assault – offender in company with other person and sexually touch another person.
Jayden Paulley’s lawyer entered pleas of not guilty to seven charges including aggravated sexual assault in company inflicting actual bodily harm, two counts of aggravated sexual assault – offender in company with other person, sexual touch another person, sexual intercourse without consent, intentionally record intimate image without consent and intentionally choke person with recklessness.
Magistrate Kirralee Perry described the charges as “extremely serious allegations”, setting them down for trial at Gosford District Court.
The court heard Paulley’s bail security of $150,000 had been pledged by family members.
“Since his release on January 28 he has been compliant with no sign of offending or flight,” his lawyer stated.
Charge sheets tendered to the court allege that the incident occurred in Mardi in November 2021 with Galey-Newbury and Paulley having sexual intercourse with the victim without consent, in the company of each other.
It is alleged that Paulley hurt the victim by “placing her in a headlock” and holding her down, while also recording some of the alleged sexual acts.
The charge sheets allege that Paulley said “put your dick in her mouth” and Galey-Newbury allegedly forced the victim to perform oral sex on him.
It is also alleged that Paulley started to choke the victim during sex.
“I have to leave. Stop, get off me,” the victim allegedly said according to the charge sheets.
The men were arrested on December 16 2021 and are on bail under strict conditions.
Both Paulley and Galey-Newbury’s matters have been listed for arraignment on August 18 at Gosford District Court.
