Bateau Bay: Ex-con Michael Kendall admits breaking a man’s leg in street fight

An ex-con has admitted breaking his neighbour’s leg after being confronted about walking shirtless down the street swearing at his own dog.

An ex-con punched a neighbour in the leg so hard he caused a compound fracture of the man’s shin before running off screaming “get to the f--king hospital, I broke your leg”, a court has heard.

Michael Kendall, of Bateau Bay, faced Wyong Local Court last week where he pleaded guilty to reckless wounding causing grievous bodily harm.

An agreed set of facts states the 37-year-old was walking shirtless down Adrian Close, near his house, about 8pm on November 18 with his dog “Bella”.

The facts state Kendall was swearing at the dog which prompted a then 33-year-old resident to walk down his driveway and confront him.

“Tensions between the two immediately started to escalate,” the facts state.

“The victim said ‘I came out to see if you were alright c--t’.”

Kendall told the resident to “have some respect bro” but the victim replied for him to “keep his voice down” because he had “kids in here”.

Kendall started to walk away and the resident followed him to his next-door neighbour’s driveway where Kendall turned around and punched him twice in the head.

The facts state the two men started brawling in the street in front of horrified onlookers, including children, who had come outside to see what the commotion was about.

“At a point during the struggle, the offender punched the victim with force to his left thigh area,” the facts state.

“As a result, the victim sustained a grade one open fracture to the left tibia and a fracture to the fibula midshaft with anterior displacement.”

Later the victim ended up on top of Kendall who poked him in the eye and screamed to “get off” but the victim said he couldn’t because of his leg.

Another neighbour arrived home and saw Kendall had gained the upper hand and was standing over the victim.

Kendall then ran off screaming “get to the f--king hospital, I broke your leg”.

The victim was taken to hospital where he underwent surgery and had a metal rod inserted in his shin.

Police knocked on Kendall’s door about 150m away but he initially denied any knowledge of the assault, including when police showed him CCTV taken from one of the houses.

He was adjourned to face Gosford District Court on October 3 to fix a sentence date.

Court documents state Kendall was jailed in 2013 for a minimum of six years after being found guilty by a jury of the attempted rape of an elderly woman at Port Macquarie the year before.

The jury found Kendall, who was 25 at the time, was kicked out of a rehabilitation facility for being aggressive before getting drunk the following day on July 7, 2012.

The court heard Kendall entered a gated retirement community and broke into a 71-year-old woman’s house before attempting to rape her but ran off when a neighbour rang her doorbell.
