A former Central Coast police prosecutor has pleaded guilty to stalking and breaching an apprehended violence order (AVO) but is yet to plead to a more serious charge of being armed with intent after she was found outside her ex-husband’s place allegedly armed with two large knives.
Kristy Lea Madden, 46, of Toronto, faced Belmont Local Court on Monday where she pleaded guilty to stalking and two separate counts of breaching an AVO.
However, the former Tuggerah Lakes police prosecutor did not enter a plea to a further charge of being armed with intent to commit intimidation.
A set of police facts in the stalking and AVO matters states police were called about 11pm on Thursday, July 18, by her ex-husband after she rang his phone eight times and left drunken voicemails.
The facts state Madden was previously subject to an AVO which banned her from contacting him within 12 hours of consuming alcohol.
Police later arrived at her Toronto address and found Madden in a bedroom drinking wine.
She became “combative and aggressive before losing emotional control” and police took her into custody where she told officers “I rang him up to say I loved him”.
Madden was too intoxicated to be interviewed at the time but, after a few hours, police granted her bail at 4am.
About 2pm that afternoon, a neighbour of her ex-husband arrived at her Lake Macquarie home at Barnsley and parked in her driveway.
Police will allege the neighbour saw Madden sitting on the boundary of her property allegedly “holding two large kitchen knives, one in each hand”.
“Out of fear of the accused, the witness has returned to her car and fled up the street,” the facts state.
The neighbour rang triple-0 as well as Madden’s ex-husband’s new partner, telling them to lock their doors and windows because Madden was outside their home.
Police arrived a short time later and found Madden in the driveway of her ex-husband’s home.
“Upon speaking to the accused, police made observations that the accused was moderately intoxicated,” the facts state.
“The accused smelt of intoxicating liquor, could not stand up straight and was dishevelled.”
Madden admitted to going to her ex-husband’s home but said when she knocked on the door, he answered and “produced a knife” which resulted in an injury to her left hand.
Police could not locate a wound on Madden’s hand however could see a small amount of dried blood.
She denied having any knives.
“The accused stated that she was intoxicated and had been at home drinking wine prior to the incident occurring,” the facts state.
Police spoke to her ex-husband who denied any confrontation and said he didn’t know she was there until his neighbour rang his new partner and they looked out the window and saw her standing in the driveway.
The court heard police located two large kitchen knives discarded in the front yard of his property.
In court, Madden’s solicitor sought a “lengthy adjournment” to enable her to go back into rehabilitation as a “day patient” with the intention of seeking full-time residential care.
Her bail was continued and the matter was adjourned to October 29.
