A man, 33, who cannot be named for legal reasons, has told a court he knew molesting his stepdaughter was wrong but ”it felt good” at the time.
The man pleaded guilty to two counts of intentionally sexually touching a child aged between 10 and 16 and one count of aggravated sexual intercourse with a child.
He was sentenced on Friday at Gosford District Court where he gave evidence, telling the court his offending was “like a blur”.
“I don’t really remember exactly what happened. I know I’ve done wrong,” he told the court.
When asked how he felt about the offences he said “disgusted, really disgusted”.
“I am just really sorry, I have wrecked her life,” he told the court.
He said he felt “scared while committing the offences” and “physically shaking when I did it”.
However when questioned by the Crown he agreed that he told the police that “it felt good” when he did it.
The court heard that he told a psychologist “every time I did it, I vowed not to do it again”, however he could not control his urges.
He told the court he was intending to seek help for his sexual offending and had enrolled in a cleaning certificate and a carers course during his time in custody.
He told the court he spoke with his mum every day and was planning to live with her when he was released.
An agreed set of signed facts states the man lived with his wife and her daughter at Chain Valley Bay and indecently assaulted the girl over a period of six months before making her perform a `sick’ sexual act.
Some time between January and June 2020 the victim was in her bedroom watching YouTube when he came in and knelt down beside her and began to rub against her when they were both fully clothed, the facts state.
“The victim didn’t tell anyone what happened, as she didn’t understand what had occurred,” the facts state.
Over time he started coming into her room and engaged in the same kind of conduct, which always occurred when the victim’s mother was at work or still asleep.
On one occasion after he had left, the girl locked her bedroom door but he came back and unlocked it with a butter knife.
“The offender tried to move the victim’s arms away so he could touch her breasts but she didn’t move her arms and eventually the offender gave up. He said `Sorry’ and left the room,” the facts state.
On June 28, 2020, he went into her room while she was alone looking at Instagram on her tablet and stood in front of her and made her perform a sexual act.
According to the facts the victim said “stop it” and “no I don’t want to do it” and he eventually left the room and she started crying before texting her mum at 6pm.
Her mother missed the first couple of messages but soon arranged to leave work and messaged her daughter to confirm she was telling the truth because he “will go to jail over this”.
“The victim responded: `I am telling the truth I promise. Please hurry I need to get out of here’ and `I feel like a bad child mum I don’t want dad to go to jail’,” the facts state.
When her mother got home she yelled at her husband “Why? What have you done?” and he responded “I’m sorry, I f...d up” before leaving the house.
The man’s brother made contact with him and later drove him to Wyong Police Station where the man told police “Yeah, I’ve f.....d up”.
During his recorded interview he told officers “I asked her if she would do it again and she said no, so I … walked out”.
“I am so gutted with what I have done, I am willing to pay my consequences, I have done the wrong thing,” the man told police.
When asked if he understood what he did was not love he answered: “That’s correct … It’s something sick and I need to get help for it, I don’t understand what happened, I dunno how it come over me.”
The man was sentenced to seven years jail with a non-parole period of four years and three months.
With time served since his arrest on June 28 last year he will be first eligible for parole on September 27, 2024.
