A Downer man has walked free from the ACT Law Courts after he was convicted of common assault relating to an incident where he brazenly propositioned a 14-year-old girl in a carpark.
Christopher Joseph Lichtwark, 37, faced the ACT Magistrates Court for sentencing on Thursday after pleading guilty to a common assault charge.
Court documents state the 14-year old-victim had visited Dickson Woolworths on October 12 at 7.30pm.
She walked over to the Dickson Place carpark to wait for her father to pick her up and she noticed Lichtwark was following her.
Lichtwark approached her and said words to the effect of “you’re sexy”, “you want to come back to my place across from the petrol station?”, and “I’ll give you $50 if you come back to my place.”
The girl told Lichtwark she was 14 and asked him to leave her alone.
Lichtwark then moved closer to the teen and began rubbing his shoulder against her arm and at one point grabbed her shoulder.
The actions led to him being charged with common assault.
She told him again to leave her alone and said her father would be picking her up soon.
Soon after the girl’s father arrived and the teenager immediately told him what had happened, and pointed Lichtwark out as he had moved to The Tradies club carpark.
Her father drove over to Lichtwark and said words to the effect of:
“Oi mate are you going up to underage girls and asking them to go back to your house?
“That's my daughter over there, she's a minor, that's not cool.”
Lichtwark began to walk away towards KFC Dickson and the girl’s father followed him in the car.
Lichtwark was seen with two other men outside KFC Dickson when the father asked his daughter to call police.
The victim’s father approached Lichtwark again while recording on his phone and the offender slapped the man’s phone out of his hand.
But undeterred, the girl’s father picked up his phone, resumed recording and asked Lichtwark for his name.
Lichtwark replied “Chris” and walked away.
The father found Mr Lichtwark’s wallet on the ground and noticed it contained a $50 dollar note and an ACT Proof of Age card matching the offender’s appearance.
Lichtwark was arrested over the incident on November 3 at 7.30pm at his Downer townhouse.
The court heard Lichtwark was already subject to a 24-month good behaviour order at the time of his offending over a common assault.
Special Magistrate Jane Campbell convicted Lichtwark and sentenced him to a 24-month good behaviour order and 50 hours of community service.
