Alleged Finks affiliates Domenico Luca Costanzo, Yazin Al-Naqib arrested during raid in Canberra

Two accused Finks bikie affiliates have been arrested during a targeted raid with detectives investigating the origin of a pill press allegedly found in their apartment, a court has heard.

Two men accused of being affiliated with bikies have been arrested by police after a pill press was allegedly discovered during a raid on a Gungahlin apartment.

Domenico Luca Costanzo, 28, and Yazin Al-Naqib, 35, both of Gungahlin, were taken into custody on Tuesday after an Australian Federal Police Tactical Response team raided a northern Canberra home about 5am.

Police facts tendered to the court on Wednesday reveal officers allegedly found a suspected pill press, vials containing a liquid substance, pills, tablets, white powder, crystallised substances, $2350 and other drug related items.

The court heard these items were still being tested by police with Costanzo and Al-Naqib not charged in relation to these items, but were taken into custody on separate offences.

Court documents allege while the pair were sitting inside the apartment during the raid Costanzo gestured to police that he needed to vomit.

Police went to grab a bowl from the kitchen when the 28-year-old allegedly got up, grabbed his phone and chucked it from his 13th storey apartment balcony, according to court documents.

A further search of the apartment would allegedly uncover body armour with protective plates inside, which is a prohibited item, however Costanzo said he bought it as a costume and didn’t think it was real.

He was charged with perverting the course of justice and possessing a prohibited item without a permit.

Defence lawyer Michael Kukulies-Smith said the prosecution’s case was “very, very speculative” and seemed to be based on “police assumption and nothing more”.

Mr Kukulies-Smith said on the face of the phone throwing charge its nature was “very unsophisticated” and submitted the 28-year-old did not have the technological means to interfere with the investigation.

Prosecutor Luke Crocker alleged Constanzo was allegedly “affiliated” with the Finks Outlaw Motorcycle Gang and was previously seen in a gang jumper with other alleged bikies.

Mr Crocker further alleged bikies were known for illegal activity and drug trafficking however chief magistrate Lorraine Walker said she needed to see evidence of that before the court.

She granted Costanzo bail on strict conditions, however his co-accused Al-Naqib was not so successful in his bid for freedom.

The 35-year-old faces a charge of failing to comply with an order made by a magistrate where it was alleged he failed to give police the passwords for his phone and laptop during the raid.

Mr Crocker alleged the 35-year-old was a “well known member” of the Finks, with defence barrister James Maher saying his client could comply with strict bail conditions.

Ms Walker however refused Al-Niqab’s bail on the grounds of the charge and his criminal history.

Both men had their matters adjourned to early October.
