A delivery driver has narrowly missed out on jail time after she missed a stop sign and crashed into another car, pushing it over the other side of the road and up onto the footpath.

Jade Ann Marshall, 23, appeared in Goulburn Local Court on Wednesday after pleading guilty to negligent driving occasioning grievous bodily harm.

The Goulburn woman, who works as a delivery driver for Samran restaurant according to court documents, was driving along Coromandel Street in Goulburn on August 26. Court documents reveal she was driving at a speed of 40km/h an hour when she reached the intersection with Combermere Street.

Instead of giving way as directed by the road sign, Marshall drove through the intersection and ploughed into another car. According to court documents, the impact of the collision pushed the car all the way onto the opposite side of the road and up onto the footpath before it stopped.

Court documents reveal there was debris all over the road when Marshall got out of the car to check on the victim, who remained in the driver’s seat of his car.

The court heard the 86-year-old man was hospitalised after the crash and had to undergo surgery for his injuries. Magistrate Geraldine Beattie said doctors had to insert screws into the man’s ankle as a result of the crash and emphasised the lasting impact on his health.

“He still has a stinging sensation in his ankle,” she said.

“All because you didn’t give way.”

The prosecution stressed Marshall is a “newer driver” whose lack of attention to road signs has severely impacted the life of the 86-year-old victim.

“The victim will have difficulty going forward in terms of rehabilitation,” she said.

Marshall’s lawyer Jack Reid told the court his client couldn’t see the give way sign due to the incline of the hill, and assumed the intersection had the same rules as the one before it. While Mr Reid said her assumption didn’t excuse her behaviour, he argued it did reduce the severity of the offence.

“(S)he acknowledges she wasn’t paying sufficient attention to the road,” he said.

Mr Reid told the court his client visited the 86-year-old victim in hospital and ensured her insurance covered his medical expenses. He said Marshall had reflected on her actions and was very remorseful.

“She realises her licence is not a right, it is a privilege,” he said.

Magistrate Beattie concluded Marshall is an “inexperienced driver” who caused the victim grievous bodily harm through her inattention on the road.

“Your responsibility as a driver is to look out for signs,” she said.

“This poor other driver is paying the price.”

However, she also noted Marshall had tended to the victim at the scene and had done the traffic offenders program.

The magistrate sentenced Marshall to a nine-month community corrections order and fined her $1200. Marshall is also disqualified from driving for 18 months.
