Sexting: are you a victim of 'sextortion'?

A young Goulburn man has avoided jail after posting intimate photos of his ex girfriend in an attempt to blackmail her into getting back together with him.

Luke Martin Gosper, 22, faced Moss Vale Local Court this week after pleading guilty to threatening to distribute an intimate image without consent and using his mobile to harass his ex-girlfriend on the night of February 20.

After his girlfriend left him because he cheated on her, Gosper threatened to post intimate images of her on Snapchat, Instagram, and Facebook if she didn’t agree to get back together with him.

The court heard Luke Martin Gosper threatened to make his ex’s life “miserable as I f***ing can”.

After the breakdown of their relationship on February 18, Gosper texted the victim to ask her to give the relationship a second chance.

When the victim asked him to stop texting her, he became emotional and aggressive.

“Do you want to f**k with my feeling(s) I’m going to f**k with your life forever,” texts read.

“Your photos are getting posted to Facebook as we speak.”

After threatening to put a knife in his own chest, Gosper turned his anger to his ex. The victim got a text telling her to look on Instagram, where she saw an intimate photo that she had shared with Gosper during their relationship.

The court heard Gosper continued to threaten to post the image to social media platforms if the victim didn’t agree to resume their relationship. He sent her images of her genitals which he threatened to distribute on Facebook, Snapchat and Instagram.

He then demanded she change her relationship status on Facebook to being in a relationship with him and, when that wasn’t done, he posted an intimate image of her to Snapchat. A text from him following the revenge porn read simply “lol”.

Court documents reveal “the threats have caused the victim a significant amount of fear, embarrassment and anxiety”.

When arrested on February 21, Gosper admitted to police he had used the photos to blackmail the victim.

Luke Martin Gosper said he has since deleted the images of his ex girlfriend.

Court documents also reveal Gosper sent a barrage of approximately a hundred texts over two days, many of which were abusive.

Magistrate Mark Douglass was unequivocal in his judgment.

“What you’ve done is wrong,” he said.

“What you’ve done is unlawful and it’s pretty serious.”

He sentenced Gosper to a year-long community corrections order, to be supervised by Bowral Community Corrections, as well as a $500 fine. Magistrate Douglass also ordered Gosper to participate in treatment for anger management.
