Glenn Robinson charged over alleged Anzac Day gang rape

A former soldier is one of three men accused of the rape of a woman on Anzac Day. It’s alleged the trio dressed the woman ‘like an Anzac’ as the attack unfolded, a court heard.

A corrective services officer is one of three men charged over an alleged Anzac Day gang rape of a woman who they met during a night of drinking at a pub in Sydney’s north west.

Glenn Robinson, 35, of Warrimoo, was refused bail at Penrith Local Court on Wednesday, charged with six counts of aggravated sexual assault in company over the alleged incident last month.

Police allege Robinson and a friend were drinking at The Fiddler in Rouse Hill in the early hours of Anzac Day when they invited the woman back to a house in Riverstone where the alleged rape took place.

Robinson, who has worked as a corrective services officer for five years and served with the Australian Army for more than a decade, appeared at court from custody via audio-visual link, with his partner, colleagues and friends supporting him from the gallery.

Reading aloud police documents in court, Magistrate James Gibson said it was alleged the woman had been drinking heavily at the pub when she met Robinson and another man, before an Uber was ordered to take her to the Riverstone address where a third man was present.

Police allege the next thing the woman remembered was waking up on a couch in the lounge room with a belt tied around her neck to choke her and one of the co-accuseds having sex with her from behind.

The woman allegedly told police she was “passed around the three men who had sex with her in multiple ways, either at the same time or individually while the others were watching, at one pointing dressing her up like an Anzac in a navy blue army jacket”, Magistrate Gibson read.

The woman suffered pelvic pain the following day and attended a hospital, the court heard.

Police photos tendered to the court allegedly showed extensive bruising to her arm and upper thigh.

Officers intercepted a phone conversation between Robinson and one of the co-accuseds, who allegedly admitted to having sex with the woman, but did not believe she did not consent because she did not say “no”.

During a police interview, the court heard Robinson made further admissions to having sex in the company of the other men.

Police prosecutor Adam Young opposed the application for bail, alleging there was CCTV evidence which showed the woman stumbling out of the pub in such an intoxicated state, she left her mobile phone behind.

Sergeant Young alleged the woman’s drunken state meant she was unable to consent and it should have been “obvious” to the men.

Robinson’s defence lawyer said he denied allegations of raping the woman, with consent a key issue if the case proceeded to trial.

He told the court Robinson’s alleged offending was “completely out of character”, with him having a significant history of community work, including in bushfire relief.

It was further heard that Robinson would need to be placed in protective custody if refused bail due to his area of work as a correctives officer.

However, Magistrate Gibson said the police evidence was strong, citing the defence argument that “the thrust of her consent was her not saying no”

He said: “There is very considerable evidence of the level of intoxication of the complainant in these proceedings to the point where she left her mobile phone when she departed in the company of the accused and one of the co-accuseds.

“There is also evidence to suggest at the time she was in the middle of her period and had expressed to a friend a view as to whether she was prepared to meet any person for sexual intercourse on that evening.”

Robinson faces up to 20 years in jail if convicted. He was refused bail and will return to court in July.

Court documents reveal the two co-accused in the case are Josateki Setuata and Joe Noamua Tauiliili.

Setuata, of Riverstone, was also charged with six counts of aggravated sexual assault – offender in company with other persons.

He appeared in Blacktown Court on Wednesday and was released on bail ahead of his next appearance.

Joe Noamua Tauiliili, 31, was arrested in Amberley, Brisbane, about 2pm on Wednesday.

He appeared before Brisbane Arrest Court on Thursday when magistrate Robbie Davies granted the extradition order.

Mr Tauiliili will be taken to Sydney Central Local Court on Friday to face six charges of aggravated sexual assault in company. He did not apply for bail.

A Corrective Services NSW spokeswoman confirmed that two of those before the courts – one of which is Robinson - were correction officers at Greenway Correctional Complex, just outside of South Windsor.

The spokeswoman said both had been suspended.

“ Corrective Services NSW will continue to support NSW Police with the investigation,” she said.

“As the matter is now under investigation, it would be inappropriate to comment further.”
