Arthur Alliband: Seven Hills rapist appeals jail sentence

A serial sex offender who has been caught watching horrific incest and beastiality pornography has made a disturbing admission to a psychiatrist.

A convicted child sex offender browsed disturbing incest and beastiality pornography online just weeks after he was released from prison over the rape of a teenage girl in western Sydney.

Arthur Alliband, 32, was jailed for 10 months after admitting to viewing pornography on his mobile phone, despite being banned from doing so.

The serial offender was jailed for four and a half years after a terrifying sex attack on a 16-year-old, after he plied her and her 15-year-old friend with alcohol at a park in Seven Hills in 2016.

The crime sparked outrage after it was revealed Alliband had only been released from jail on parole on the morning of the assault after serving time for having sex with a 13-year-old girl.

He was released on parole in October last year and was placed on an extended supervision order after being deemed a “high risk offender” in the Supreme Court.

A condition of the order prohibited Alliband from viewing any material deemed pornographic, legal or otherwise, without notifying his supervising officer.

During an appeal hearing at Parramatta District Court on Tuesday, the court heard Alliband had made “sporadic” searches of pornographic websites on his mobile phone between November and December 2020.

Judge Chris Craigie described the material as “highly offensive”.“The titles of a very considerable number of items access themselves strongly infer a repeated theme of explicit content related to sexual activities including those of an incestuous kind involving young teenage females,” he said.

“Some of the titles suggested beastiality and also acts that plainly lead to the risk of impregnating the teenage females involved in an incestuous setting.”

Citing a psychiatric report, Judge Craigie noted that Allibrand did not meet the criteria to be deemed a pedophile.

“There is a possible sexual deviance and preoccupation in his victim choice that may be explained by him choosing more vulnerable and easily coerced victims who are teenagers rather than an attraction to young females,” he said.

The court heard Alliband had told a psychiatrist he “did not feel like an adult inside”.

At an earlier appeal hearing, the defence argued Alliband had received no psychological treatment during his time on the order and had a “questionable” ability to interpret his supervision conditions due to his low IQ.

“The promptness with which he fell into a breach, the particulars of the kind of material he viewed and the volume accessed over a relatively short period simply illustrate the sound foundations of the determinations made in the Supreme Court,” Judge Craigie said.

Judge Craigie dismissed the appeal while acknowledging Alliband’s risk to the community.

“Without supervision and restriction, (Alliband) was found to be a person whose liberty represents an unacceptable risk to vulnerable young female members of the community.“His behaviour in this instance illustrates again the nature of the risk.”

A judge has described as “repugnant” the pornography a convicted sex offender was caught watching following his release from jail over a terrifying sex attack.

Arthur Alliband, 32, was jailed for four and a half years over the rape of a 16-year-old girl at a park in Seven Hills in March 2016.

Alliband’s attack came just hours after his release on parole after serving 18 months for having sex with a 13-year-old girl.

Within hours of his release, the serial offender befriended two girls on a train, aged 15 and 16, before luring them to Best Road Reserve at Seven Hills and raping the older girl.

He was released on parole for the crime in October last year before being placed on a supervision order imposed in the Supreme Court.

However, Alliband was thrown back in custody in January after it was discovered he had viewed pornography, which he is banned from doing so, while subject to the order.

As part of the order, Alliband was ordered to undergo extended supervision for two years and seven months.

A check of his phone by supervising officers discovered he had viewed pornography between November 14 and December 2 last year.

He was subsequently jailed for up to 10 months and faced Parramatta District Court on Monday to appeal the severity of his sentence.

The defence argued Alliband had received no psychological treatment during his time on the order and had a “questionable” ability to interpret his supervision conditions due to his low IQ.

The court heard that while Alliband did not meet the criteria to be deemed a paedophile, he suffered from complex trauma stemming from childhood abuse as well as ADHD.

Judge Chris Craigie noted that while the pornographic material was not illegal, Alliband’s viewing of it without notifying his supervising officer, was.

However, he described the material as “repugnant”.

“The titles of some of the materials suggest involvement of juveniles … some suggests fairly gross material beyond the bounds beyond of what one might describe as ordinary pornography,” Judge Craigie said.

“It appears to me on its face, there’s no argument the breach has been committed and concerns an area of a certain risk given the behaviour was not brought to the notice of those supervising.”

He noted Alliband’s sentence to be “benign” given his extensive criminal history.

Judge Craigie reserved his decision for later this month.
