Andrew Atkins violent attack on partner with syringes, party pies

A man pressed the burning hot filling of party pies into his partner’s skin and threw syringes at her in an incident described in court as “incredibly disgusting”.

Australia's domestic violence crisis

A man subjected his partner to terrifying acts of violence in which he threatened her with an axe, threw syringes at her and scolded her with the filling of party pies.

However, Andrew Atkins was handed an intensive corrections order to be served in the community having been on remand for a month and 10 days.

Blacktown Court heard the horrific chain of events started around 5.30pm on August 13 when the 34 left his Doonside home with their dog to get beers from the local shop.

When he returned at 11pm he approached his partner and held an axe to her and demanded she give him $50.

Atkins told her “I just axed the dog, it’s your fault” before she “panicked and transferred him $50,” the facts read.

He confronted her again, asking about how she knew about a taxi fare before threatening to cut off his own toes with the axe.

The court heard “he hit the floor with force three times, causing a loud bang each time.”

He then took her iPhone and threw it against the wall, causing it to completely shatter.

The next night Atkins once again confronted her around 10.30pm, asking her about who else had been inside the home.

When she replied “no one”, he grabbed her neck, applying pressure which caused her to fall to the ground.

He then went to the kitchen and put party pies and sausage rolls in the oven.

Once cooked, he approached her, sitting on the bedroom floor, with the hot pastries and pushed them into her arms and body so the hot processed meat burnt her skin.

The court heard while he “smudged the pies against her skin” he was yelling derogatory remarks at her such as “you’re a s***’.

He then proceeded to throw various items at her including pies and sauce, a paint scraper, a knife and a stapler.

At 4am that night, he again began asking her about a taxi fare and said: “This is going to be the end. If I don’t end up getting away from you, I’ll end up killing you.”

He then went back to sleep before waking at 10am claiming that she had drugged him.

The court heard he approached her with 10 capped and uncapped syringes and threw them at her. Some hit her while others were left spread across the floor.

He told her to pack her bags, adding “we are going bush. I don’t care what you pack just pack.”

Fearful for her life she contacted her relatives through her iPad and asked them to get in touch with police.

When officers arrived he told them, “Yeah I know. I was angry and I told her I need to go to Bungarribee. I am going to hurt you.”

While in the police van he could be heard saying, “F*** off. I’ll assault you. Charge me with that too.”

When questioned about the incident, Atkins told police he was angry towards the complainant due to believing that she had used all his dole money to purchase illicit drugs.

Magistrate Brian van Zuylen in court on Thursday described the facts as “very serious” and labelled his actions “incredibly disgusting”.

Atkins’ lawyer told the court he had spent one month and 10 days in custody and asked the court to consider an intensive corrections order while he continues to get help.

Atkins, through his lawyer, pleaded guilty to all charges: stalk and intimidate, damage phone and damage property, assault, choking and common assault.

Magistrate van Zuylen, said given the current Covid situation it is in the public’s interest to keep people “out where possible.”

After taking into account his time in custody, he sentenced Atkins to a 12 months intensive corrections order with strict conditions meaning he is unable to reside at the Doonside residence or consume any illegal drugs.
