A MAN who was kicked out of a hotel for dancing on the bar has seen his brother go to jail for biting the nose of a security guard.

David Robert Perham, 33, and Shawn Douglas Perham, 43, were patrons at the Tandara Hotel in Sarina near Mackay on May 18 last year.

The Townsville Magistrates Court heard the Townsville brothers had been drinking at the hotel and were significantly intoxicated when David jumped on the bar.

David was asked to leave the premises by the hotel bartender manager and complied, along with his brother.

The court heard five minutes after the men left the hotel, Shawn re-entered the hotel and assaulted a hotel security guard.

Police prosecutor Subarna Raut said the security guard sustained multiple injuries from the attack.

“At the time the defendant has re-entered the hotel he has proceeded straight to the victim and proceeding his assault against him,” he said.

“It involved multiple punches to the victim and also finally the defendant biting the victim on the nose causing the victim’s nose to bleed.”

Mr Raut said the assault was caught on CCTV camera footage but was “grainy”.

David pleaded guilty to public nuisance within licensed premises and refused entry to licensed premises.

Shawn pleaded guilty to five charges including assault occasioning bodily harm whilst armed or in company.

Defence barrister for Shawn Harvey Walters said his client was defending himself after the security guard pinned him to the ground.

“The complainant eventually gets on top of my client and it’s whilst he gets on my client on the ground that the bite occurs,” he said.

Defence solicitor for David Mathai Joshi said his client was embarrassed when he watched the CCTV camera footage.

“He is extremely remorseful for his behaviour,” he said.

Magistrate Ross Mack told David his offence was a “lack of character” and fined him $750. Convictions were not recorded.

Mr Mack told Shawn his actions were an over-reaction.

“You should not have gone back; you should not have thrown the first punch,” he said.

Shawn was sentenced to nine months’ jail to serve three months with an operational period of 18 months.

Convictions were recorded.
