Man allegedly used replica firearm to rob Maroochydore chemist

A MAN who stole a bottle of alcohol from a Townsville liquor store had been released on parole only days earlier.

Kyle Adrian Paul Clancy, 27, entered the Dan Murphy’s Dalrymple at Garbutt on June 10 last year.

The Townsville District Court heard Clancy entered the store and initially picked up a bottle of whiskey.

As he attempted to walk out of the store without paying, Dan Murphy’s staff blocked him from leaving and took the bottle.

Crown prosecutor Catherine Holden said Clancy was well known to staff at the store.

“The defendant continued to walk towards the exit but turned back and then suddenly lunged at the complainant and tried to get the bottle back from him,” she said.

“As he turned to leave the store again he grabbed a bottle of rum and left the store without paying.”

Ms Holden said the offending was captured on store CCTV cameras.

Clancy was arrested by police on June 19 last year and has spent 265 days in pre-sentence custody.

The court heard Clancy had been released on parole only days before the robbery and had a lengthy criminal history with like offences.

He pleaded guilty to robbery with personal violence.

Barrister Dane Marley said his client became addicted to drugs after his mother committed suicide.

“It was at that point his drug use became a lot more constant fixture to deal with his grief,” he said.

“He would have approximately a point of methamphetamine a fortnight.

“Alcohol is also a significant issue. He drinks every day and at the time he was capable of drinking a whole bottle of rum straight.”

Mr Marley presented Judge Brad Farr SC with a reference written by Clancy’s grandfather, who said he would support his grandson when he was released from jail.

Judge Farr SC told Clancy he was lucky to have his grandfather supporting him in court.

“You ought to be grateful to have his continuing support. As a consequence of him, you have a home to go to on your release from custody,” he said.

“It would seem, at least, your intention at the moment is to try and assist your grandfather and perhaps prove to him you are worthy of his support.”

Clancy was sentenced to 274 days’ jail with an immediate parole eligibility date.
