Court hears of brawl on main street of Ayr follwing kebab shop run-in

A LATE-HOUR alcohol-fuelled fight that spilt on to Ayr’s main street has led to an innocent female bystander being caught up in the scuffle and others narrowly avoiding injury.

The Ayr Magistrates Court heard that between 60 and 70 people were near Sisay Kebabs in Queen Street after the nearby Queens Hotel closed for the night on October 11.

Police prosecutor Codie Rowe said it was about 1.50am when CCTV footage captured Slade William Farrell and another man talking in the kebab store before the argument escalated.

“The footage shows an escalating argument, then the defendant adopted a jaded stance,” Mr Rowe said.

“The defendant then throws multiple punches at the male. Many of the swings narrowly miss other members of the public standing in line.”

Farrell, 21, pleaded guilty to one count of public nuisance.

Police had been called as the fight spilt on to Queen Street.

“At one point the defendant threw a punch at the other male which ricocheted off and into an uninvolved female,” he said. Mr Rowe submitted the incident was protracted in nature and that a period of three months’ imprisonment would “reflect the serious nature of the offending”.

Defence solicitor Michael Spearman submitted the offending was out of character for Farrell with no previous history of a similar offence.

“Mr Farrell is embarrassed by his actions, he’s remorseful, he’s very unhappy to be here,” Mr Spearman said.

The court heard Farrell had also been hospitalised for a period for injuries he sustained during the fight.

Acting Magistrate Scott Luxton said Farrell was fortunate no complaints had been made by bystanders who were injured.

“As a result of what took place, a number of innocent parties have attempted to intervene and became victims,” Mr Luxton said.

“You are extremely fortunate, as was the other offender that no complaints were made from those people.

“Had that been the case then the court may well have considered the penalty that Mr Rowe has submitted.”

Farrell was fined $800. No conviction was recorded.
