For seven years, Malcolm Boyce has waited for justice over the senseless and unprovoked ambush murder of his innocent son, Mark.
In the wrong place at the wrong time, Mark was set upon by three bikie-affiliated men and beaten to death.
Not even the conviction of one man, several years ago, could ease Mr Boyce’s pain knowing two more remained in the community.
In the Supreme Court public gallery on Friday, Mr Boyce burst into tears as a second man – Hells Angels’ member Tobias Sahlstorfer – was also found guilty of the murder.
“Yes, yes,” Mr Boyce said, wiping away tears and tightly gripping the hand of a supporter as Justice Laura Stein delivered her verdict.
Sahlstorfer, meanwhile, stood impassive in the dock with his hands folded in front of him, shaking his head.
Outside court, Mr Boyce praised prosecutors and SA Police for apprehending two of the killers, saying: “It’s taken seven years to get this far – two down, one more bastard to go.”
“They (police) do know who he is, it’s just time … it won’t bring Mark back, but it’s slowly given us justice,” he said.
“It’s just fantastic and, as far as I’m concerned, they (the murderers) can all rot in hell, they can stay in jail.
“They took my son’s life, he wasn’t the intended victim … he would have been 44 (years old) this year.
“Yes, he was in the wrong place at the wrong time and look, he was no angel, but he was my son … I miss my son every day, he was the only child I had.”
In January 2017, Mark Boyce was kicked, punched and stomped to death near his Hill St, Elizabeth South, home.
Another man, who had links to the Hells Angels Outlaw Motorcycle Gang, was arrested and stood trial, with prosecutors alleging the fatal ambush took just 20 seconds.
That man’s identity remains suppressed and, under existing court orders, cannot be reported in connection with Sahlstorfer.
Prosecutors further alleged Mark was an innocent victim who was “in the wrong place at the wrong time”, as the attackers had intended to set upon another man.
The intended victim, whose identity is also suppressed, told the Supreme Court he blames himself every day for causing the death of his “best mate” – he has since died.
In 2019, the first man was convicted and sentenced to life with a 20-year non-parole period – at that time, Mr Boyce’ urged police to find and arrest the other two assailants.
A year later, Sahlstorfer was arrested, and went on to stand trial in 2023 accused of being the “main protagonist” in the bashing.
Prosecutors further alleged he had owned a blue Toyota Echo involved in the incident.
That car, they alleged, which was found cut up, burnt out and buried under 4m of “compacted sand” at a Hells Angels stronghold at Ponde, near Mannum.
His counsel, however, argued the case against their client was a “dog’s breakfast” containing “serious flaws”.
By her verdict on Friday, Justice Stein rejected those arguments, finding Sahlstorfer guilty of murder beyond reasonable doubt.
She remanded Sahlstorfer in custody to face sentencing submissions next month.
Outside court, Mr Boyce said neither Stahlstorfer nor the first man had shown remorse for their crime.
“He didn’t shake it (his head) hard enough (over the verdict) because it’s still on his shoulders,” he said.
He said the verdict was “a very big relief” after seven years of waiting, during which both he and Mark’s mother had suffered extensive health issues “due to the stress".
“I’ll never get to see my son again … I’ve still got visions of Mark laying in the hospital bed, in an induced coma … he would never regain consciousness,” he said.
“That was the last way I ever saw him.
“So as far as I’m concerned, these two can rot in hell – and the other one when they eventually get him, as well.”
