BGSZO Group, trading as Up Dog Diesel, in liquidation after underpaying worker

A South East Queensland tyre company has gone into liquidation entered liquidation after it was fined for contravening fair work legislation.

An Ipswich-based tyre company has gone into liquidation after it was fined for contravening fair work legislation.

Australian Securities and Investments Commission issued a notice on Tuesday to BGSZO Group Pty Ltd, which formerly traded as Up Dog Diesel, appointing corporate insolvency firm PCI Partners director Stephen Michell as the liquidator.

Up Dog Diesel was registered in 2019, providing tyre fitting and management, pressure maintenance, tyre coolant, rust inhibitor and other associated products and tools, according to a 2020 advertisement in a mining magazine.

The trading name was cancelled in 2022, after Fair Work Ombudsman took the company to court for its failure to pay its employee’s legal entitlements.

The ombudsman issued a compliance notice a year earlier when they believed a tyre fitter who worked at the company for a year was not paid their accrued but untaken annual leave at the end of his employment.

The company paid the worker only after the legal action started.

Judge Gregory Egan ordered the company to pay a $13,330 penalty and its sole director and secretary Dwane Johnson, who was involved in the contravention, to pay $2,652 in the Federal Circuit and Family Court of Australia at Brisbane on December 13, 2022.

A Fair Work Ombudsman spokesman said they were successful in obtaining wind-up orders against the company on October 18, placing it in liquidation.

“Speaking generally, wind-up proceedings provide an avenue for a liquidator to be appointed to investigate the financial transactions of a company and to distribute any money and/or assets to pay debts such as any underpayments and any penalties,” he said.

BGSZO Group and Mr Johnson were contacted for comment.
