Reader Caitlin recently asked: How do I get out of a fine from Australian National Car Parks? I don’t even understand how they got my home address.
Brydens’ advice: Australian National Car Parks is not a statutory authority capable of issuing fines. It has no power to do so. The utilisation of a car park operated by ANCP is done so pursuant to a contractual arrangement. The terms of that contract must be readily displayed so as to ensure that you are aware of your obligations pursuant to that contract so far as the payment of a fee is concerned for the use of the car park. If you are genuinely aggrieved so far as the imposition of the “fine” is concerned then you should send a letter to ANCP setting out the reasons for same. If ANCP decide to take the matter further then of course you will need to defend any proceedings that may be brought. As to your home address it is not a difficult matter to discover same. An application can be made to RMS to identify the registered owner of a vehicle for the purpose of litigation.
