Alicia asks: Three days before I was due to have a bowel operation at a Sydney hospital, after an eight-month wait, the surgery was cancelled. I was told the surgeon had retired. That was August 2015. I now face waiting another year for the operation. The pain is excruciating. I can’t work. I have struggled to get anywhere with the official complaints process. I believe I am entitled to compensation for my suffering, loss of income and additional costs I have incurred. Where do I stand legally?

Brydens answers: In our view there is no claim available to you. In order to bring a claim for damages you would have
to establish negligence on someone’s part as a result of which you suffered injury loss or damage. Alternatively there would have to be a breach of some contract. In the circumstances you have described there is no recognised duty of care.
