Melissa asks: If a property settlement agreement is signed and filed with the courts and the separated couple have not yet filed for divorce and get back together, does that agreement become void or does it still have legal standing?

Brydens answers: A property settlement agreement or a binding financial agreement is, as the name suggests, an agreement between the parties that is binding and enforceable.

A reconciliation by the parties will not negate the enforceability nor validity of the agreement. If the reconciliation of the parties leads to a change in circumstances that requires an amendment to the agreement, then such a document can be filed with the court.

Alternatively, if the parties are of the view that the agreement should be set aside then this can similarly occur by consent.
