SON HURT IN SURF MISHAP

Ian asks: Our son was injured while on a school study camp in January. The school took

them on the excursion. The surf was choppy with a side wash both sides of the area into which the teens were crammed. Our son fell off his surfboard and was hit by another surfboard in the stomach. This resulted in severe damage to his pancreas. He was operated on at Westmead Hospital.

He spent 27 days in hospital. Who is liable? The school, or the surf club, or both?

Brydens answers: The fact that your son has been injured does not in itself entitle him to a claim. It is necessary to establish negligence and breach of duty of care on the part of those who were responsible. It would seem that there has been neglect by those involved, which could expose them to a liability to pay proper compensation for the injuries sustained.
