MARIO ASKS: Do you have any advice about a car accident where the other party is not insured? How can I avoid paying an excess if the other party does not accept liability? Any information would be appreciated.

BRYDENS ANSWERS:

If you have suffered injury then a claim can still be brought as against the nominal defendant. However, for a property damage claim you can pursue the party responsible personally. Questions arise of course whether they have the capacity to pay for the damage caused.

If you claim on your own insurance then whether or not you pay an excess will depend upon the terms of the policy. Some policies provide that if you can identify the party responsible then you do not pay an excess.
