Darren asks: I recently walked out of a lift in a hotel and the lift didn’t go all the way to ground level and stopped short about 300-400mm and I jarred the left side of my body. I
have since been off work and still have lower back and neck issues. Is it worth seeking legal advice for compensation?
BRYDENS ANSWER: The short answer is yes. The owner and/or occupier of the premises has a positive obligation to take reasonable care for your safety.
This includes proper maintenance of the lifts so as to
ensure they work properly. If there is evidence to establish negligence on the part of the owner and/or occupier then a claim can be brought. Strict time limits apply with respect to the prosecution of such claims.
