Brad asks: My brother-in-law has been injured on my property by a ram that belongs to my neighbour. The ram escaped from the neighbour’s property during an overnight storm and ran up our driveway to attack my brother-in-law. He now requires a $6K operation and has lost wages, as well as having to cancel a prepaid interstate holiday. He has approached my neighbour’s home insurance company with a claim but has not yet been advised re any outcome after about two months. Who is legally responsible for this?
We say: The neighbour bears the ultimate responsibility for the ram. If it can be shown there was some negligence on the neighbour’s part which led to the injury, then he has an action available to recover damages for his pain and suffering, medical expenses, loss of wages and the like. Strict time limits apply.
