Lee asks:

My partner of 25 years has recently passed. No will. Some super with life policy. I have one dependent under 18 with me plus two children from previous marriage (mostly estranged, no yearly contact). Is the entitlement to policies totally applied to me as the defacto partner?

Brydens answers:

Our condolences. It does depend on the super fund, some have Nominated Beneficiaries but give the trustee’s discretion to reallocate or apportion the benefit. I would say that given the length of the relationship and the fact you still have a dependent child, the full death benefit should go to you.
