Here’s a curly query posed recently — and Brydens’ insightful response.
Kerrie asks: I inherited a portion of a house with my siblings upon my father’s death. My eldest brother was paid out his portion by my other brother and I kept my share. The house has been tenanted the entire time and I don’t receive any rent nor have I contributed to rates etc. I have been asking for some 4 years to be bought out of the property to no avail. My brother keeps finding excuses. Where do I stand legally?
Brydens answers:
You may be left with no alternative but to approach the Supreme Court for an order compelling your brother to account to you for all income derived by the estate.
