My partner wants to move; he’s 58 and I’m 50. My property is worth about $1 million and his $350,000. We both work but he currently earns more than me. Am I at risk of losing my property if the relationship fails?
Brydens Lawyers answers
It is not so much a risk of losing your property but there is the possibility a claim may be made on assets that you have brought into the relationship. Residing together for two years will constitute a de facto relationship and thereafter the parties will have an entitlement to seek a property settlement. A solution may be a binding financial agreement setting out the distribution of assets in the event of a breakup.
