Peter asks: My wife died of cancer last year. She had a liver resection. We relocated to France for further treatment. The top liver surgeon in Europe advised us that she did not in fact receive a liver resection and was extremely scathing of the surgeon over here. Do I have a legal case against him?
Brydens answers: Not only is it necessary to establish negligence on the part of the surgeon but that such negligence was causative of loss. You’d have to show the negligent treatment resulted in an adverse outcome.
