A 74-year-old man is in custody after his son-in-law was shot in the neck following a dispute at a home on Sydney’s upper north shore.

Both men were found injured in the front yard of the Highlands Ave, Wahroonga home where two guns were also seized when police arrived just after 10am on Thursday.

The men were flown to Royal North Shore Hospital, where the man in his 50s was treated for gunshot wounds to his neck and his father-in-law for facial injuries. Both were in a stable condition.

Neighbours said they didn’t know the men and believed the house was recently rented out.

One resident said her son-in-law witnessed the altercation before it escalated.

“My son in law was walking home this morning when he saw the two men fighting outside with sticks,” Jennifer Passfield said.

“We don’t know who they are that live there.”

Jarrod Walsh was walking home in the street when he heard someone yelling “help”.

“I looked in from across the road ... I saw these two older blokes trying to hit each other,” Mr Walsh said.

“They were trying to hit each other from across a car. One guy is trying to get away and the other is trying to bang him on the head with a broom or long stick.

“The next thing I heard sirens and police were storming in. Tasers drawn they said, ‘let me see your hands’.”

Kuring-Gai Police Area Command Superintendent Barry Vincent said the first officers on the scene had to ensure the men were not armed.

“They challenged both parties to make sure any potential firearms were secured,” Supt Vincent said.

He said a nearby school and preschool were quickly advised of the incident.

Chief Superintendent Tim Fairservice from NSW Ambulance said the men are stable in hospital.

“We never really know the extent of the injuries until we arrive on scene,” he said.

“We needed to make sure the scene was secure and safe before treating our patients.

“Both patients were transported in a stable condition to Royal North Shore Hospital.”
