Terranora Village Estate future to be determined by Land and Environment Court after hearing

The development application was first lodged more than 20 years ago, and now the council says plans to modify it would substantially change the entire project.

The future of a 101 lot residential subdivision in Terranora will be determined by the Land and Environment Court after a four day hearing this week.

Applicants Horseshoe Properties Pty Limited have appealed a decision by the Tweed Shire Council to refuse a modification application for stages 14, 16, 17 and 18 of the Terranora Village estate.

A Tweed Shire Council spokesman said the original application, approved in 1999, was substantially different from the proposed amendments.

“Council received a Class 1 Appeal in the NSW Land and Environment Court relating to a deemed refusal of a modification application (S96/0066.22) for a 101 lot residential subdivision and public open space comprising stages 14, 16, 17 and 18 of Terranora Village Estate,” he said.

“The modification application sought to change the approved subdivision (S96/0066) by amending the layout, and increasing the number, of residential allotments – in addition to changes to road layout and relocation of more than 5ha of public reserve.

“The refusal related to concerns with aspects of the modification application from planning, ecological and engineering perspectives.

“These included the application not satisfying the Tweed Local Environment Plan 2014 in relation to the aims of the plan, subdivision lot size, earthworks and suitable road access.

“There were further concerns that this was a substantially different application to the approved subdivision.”

The hearing before the Land and Environment Court began on Tuesday with a site visit and continues on Wednesday.
