SYDNEY’S notorious North Shore rapist is appealing his four-month sentence for failing to disclose an intimate relationship with a prostitute.

Last month at Parramatta Local Court, Magistrate Gary Still sentenced Graham James Kay to four months jail for breaching his Extended Supervision Order, saying he had been caught “red handed” and there had been no evidence of remorse or contrition.

A corrective services supervisor doing a curfew check on Kay’s western Sydney home on April 7 found a prostitute in his bedroom — breaching a condition that Kay must disclose any intimate relationship.

Yesterday dressed in prison greens and wearing glasses, Kay told Parramatta District Court he was “remorseful” for the breach.

The court heard that there was “an oversight” in his affidavit which left out the fact he was remorseful for what had occurred.

Kay’s lawyer Angela Cook also argued that the threshold for a custodial sentence had not been crossed.

“In my submission this is not the most serious example of such a breach, it is towards the lower end. Custody is a sentence of last resort,” she said.

She argued that Kay had complied with his parole and rehabilitation requirements since he was released from jail three years ago.

“Other than this one occasion he has done everything that has been required of him,” she said.

The appeal hearing before Judge James Bennett will continue tomorrow at 2pm.

Kay has also separately pleaded not guilty to assaulting a teenage girl at a supermarket.
