Jack de Belin, Callan Sinclair trial: NRL star said relationship ‘on the rocks’

Rugby league star Jack de Belin told a woman “baby it’s ok, me and my girlfriend are on the rocks” after he is alleged to have repeatedly raped her, a District Court trial has heard.

The woman was this morning cross examined by barristers for both de Belin, 29, and his co-accused Callan Sinclair, 23, over what she had told the court about the alleged ordeal inside a North Wollongong apartment in the early hours of December 9, 2018.

De Belin and Sinclair have pleaded not guilty to five counts each of aggravated sexual assault, maintaining the sex was consensual.

Craig Smith SC, for Sinclair, put to the woman that she had used the words “yes, yes” during consensual sex with the men that night.

“I was using the word no, stop,” the woman replied.

Mr Smith asked the woman if she raised a concern that Jack has “got a girlfriend” after the ordeal in the bedroom, while she was speaking to Sinclair and de Belin was in the shower.

Mr Smith then asked if de Belin emerged from the ensuite and told her “baby it’s ok, me and my girlfriend are on the rocks, it’s no drama”.

She replied “no, he never said that”.

The woman has previously told the court the men took turns sexually assaulting her as she cried, asked them to stop and felt “dead and numb inside”.

De Belin’s barrister David Campbell SC today suggested to the woman that a man appeared at the doorway of the bedroom midway through the alleged assault prompting her to ask “Jack, who’s that?”.

“Incorrect,” the woman said, denying she had ever seen another man in the apartment other than de Belin and Sinclair.

Mr Campbell said there was a short conversation in the room after the man appeared, before de Belin left and spoke to him before returning again.

“No … he never left the room, he never did any of that,” the woman said.

The woman has told the court the abuse began with de Belin undoing her shirt and pushing her onto the bed.

Mr Campbell today proposed she was in fact kissing Sinclair when de Belin approached the pair and she undid her own top.

“No why would I do that to someone I’ve never met before,” the woman said.

The trial continues.
