Torryh Shaw: Iluka woman sentenced for reckless wounding, breaching AVO after stabbing ex with scissors

A North Coast teen has been told she’s lucky not to be facing a murder charge after she stabbed her ex with scissors from behind, causing his lungs to collapse.

A Clarence teen was told she was “lucky” not to be “standing in the Supreme Court charged with murder” after she collapsed her ex-partner’s lungs by stabbing him with a pair of scissors.

Torryh Shaw’s former partner left a trail of blood through his home after the attack from behind, delivered with significant force.

The 19-year-old Iluka woman faced Grafton Local Court supported by her mother on Monday.

She pleaded guilty to reckless wounding and contravening an apprehended domestic violence order (ADVO).

Documents tendered to court reveal the night of the offending, August 25 last year, started as a friendly get together involving Shaw, her former boyfriend and a mutual friend.

They met up and had about six drinks at Junction Hill’s Blue Goose hotel before returning to the victim and his friend’s share house at Alumy Creek.

The victim and Shaw had ended their relationship about two weeks prior and there was a possibility they would recommence their relationship that night, according to police facts.

The group drank at the residence into the early hours of the following morning.

“About 12:10am, the victim and (his friend) were in the victim’s bedroom when an argument started relating to both of their recent sexual partners,” court documents state.

“During this argument (Shaw) rushed at the victim and started to punch him in the head area.”

The man did not defend himself and the mutual friend restrained Shaw.

Soon after, a similar situation occurred — Shaw punched the victim in the head and needed to be restrained until the victim left the room.

Shaw then found a pair of kitchen scissors and chased the victim, stabbing him in the back “with enough force and depth to collapse his lung”.

Shaw called police as the friend rendered first aid and told them: “Me and my ex-boyfriend were having an argument and I grabbed a pair of scissors and like I went to whack him and I stabbed him with it, and I think I punctured his lung.”

But police could not find the address the three were staying at because they were provided with “inaccurate details”, court documents state.

The trio remained in the home and the victim was left to clean up a trail of blood.

Bizarrely, Shaw took a taxi with the victim to Grafton Hospital, where he was due to see a doctor at the fracture clinic for an ankle which was previously broken.

Shaw left the man at the hospital and “while being examined the doctor noticed his wound before taking him to emergency”.

“Later that afternoon, hospital staff notified police of the victim’s injury and condition,” police facts state.

“Police attended the hospital, however, could not obtain any details due to the level of pain medication.”

Shaw was arrested on August 30, taken into police custody and an ADVO was taken out by police to protect the victim

Shaw refused to be interviewed in custody, but did state: “I wish I didn’t have to do it.”

Shaw would later breach the ADVO and made “full admissions” to police, the court was told.

She told police she was in contact with her ex because he allegedly “threatened to report her breaching her ADVO if she did not contact him”.

“(But she said) the contact continued well after that and she was a willing participant,” police facts state.

Shaw’s former boyfriend also ran into trouble with police in relation to alleged domestic violence offending on April 14, the court was told.

Magistrate Christopher Longley told the court there was an extreme level of jealousy and distrust between both Shaw and the victim.

Mr Longley said: “Two people are very lucky here.”

He said the man was lucky to be “alive to give evidence” and Shaw to be “standing in this court” instead of “standing in the Supreme Court charged with murder”.

But he said Shaw was otherwise a person of good character, she was young and he was reasonably confident she would not reoffend.

Mr Longley convicted Shaw and sentenced her to a nine-month intensive corrections order.
