A collision at a Grafton roundabout where a woman’s vehicle was hit from behind by a truck is not as simple as it seems.
Calamia youth worker Roseanne Phyliss Roe, 56, was charged with failing to give way at a roundabout on the Gwydir Highway on November 29, 2021.
The woman allegedly admitted fault at the scene and received a traffic infringement notice for $350.
Ms Roe appeared in Grafton Court on April 11, where the circumstances of the incident were detailed.
Her solicitor Dylan Beneke explained that it was a “tricky” situation and that Ms Roe had “misread” the actions of the truck after it entered the roundabout.
Mr Beneke told the court Ms Roe saw the truck shudder on the roundabout so went around the heavy vehicle as she believed it had stalled or broken down - but the truck restarted and hit the rear of her vehicle.
Ms Roe’s vehicle required towing.
Mr Beneke told the court Ms Roe was a youth worker and required her vehicle for work.
Magistrate Kathy Crittenden noted there was no negligent driving charge and Ms Roe had conceded fault.
The traffic infringement notice was upheld, without proceeding to conviction, and Ms Roe was sentenced to a conditional release order for a period of nine months.
