Daniel Wallis: Yamba man sentenced for intimidating police, driving with cannabis in system

In a fit of rage, a man threatened to “f**king kill” a former friend before turning his anger towards the police who he abused in an out-of-control tirade after they had arrested him.

Yamba man Daniel Wallis, who also spelled his surname ‘Wallace’ on certain court documents, aged 35, fronted Maclean Local Court where he was self-represented after Magistrate Juliana Crofts denied his bid for another adjournment.

Wallis had previously pleaded guilty to two counts of intimidating a police officer in the execution of their duty and intimidating someone.

According to documents tendered to court, Wallis’ terrifying outburst began just after midday on May 3, when a former friend of the 35-year-old heard his dogs barking and went to the front door.

Here, he found Wallis with “no shirt on and … screaming with rage,” a court heard.

“(Wallis) screamed, ‘come out here Trent or I am going to come in there and f**king kill you’,” police facts state.

A court heard police soon arrived and arrested Wallis who continued to yell “You f**king wait Trent, I am going to kill you” as he was lead away to Yamba police station.

When the police officers spoke to Wallis, he turned his anger towards them.

According to court documents, he yelled “F**k you with your f**king uniform, take it off you c**k sucker” at one police officer and racially abused a separate senior constable.

“(Wallis) then began to threaten (another senior constable), ‘Your son … I know where he goes to school — I am going to smash him and I’m gonna smash you’,” police facts state.

Wallis also kicked, screamed and head butted perspex when he was placed in the dock at the police station, a court heard.

Soon after, the Yamba man was once again in trouble with the law.

At court on Thursday, Wallis also entered a plea of guilty to driving while cannabis was present in his blood.

According to court documents, when police stopped Wallis on October 7 for a random drug test he told the officers he had just dropped off some family members and was heading back home.

“During the custody and oral fluid testing process, (Wallis) was belligerent towards police,” court documents state.

“In relation to the taking of drugs, (Wallis) stated, ‘Just marijuana, smoked it, everyday’.”

Addressing the matter, Wallis told Maclean Local Court he thought the cannabis wouldn’t be in his system and said “there hasn’t been any change in my lifestyle”.

Ms Crofts told the court the charges relating to Wallis threatening police were “far more serious”.

In his defence, Wallis told the court he was frustrated because on that day he had been arrested for malicious damage charges, which have since been withdrawn, and added the police officers had refused to listen to what he was telling them.

But Ms Crofts said the police were simply doing their job.

“They could have done it more easily without the comments and the threats and the intimidation from you,” she said.

For the first set of offences, Wallis was convicted and sentenced to an 18-month community corrections order.

For driving while cannabis was in his system, he was also convicted, fined $700 and disqualified from driving for three months.
