A Coffs Harbour teenager allegedly broke into a storeroom behind the Hoey Moey while he was out on bail for a number of other serious charges including assaulting a police officer.
Tyler Cody faced Coffs Harbour local court on Monday, January 31, charged with aggravated break and enter.
The break and enter - deemed to be ‘aggravated’ as it was in the company of another person - took place between 11pm pm, January 29, and 12.30am, on January 30.
The 19-year-old was already on bail for charges arising from conduct alleged to have occurred on May 16, 2021.
These matters have been adjourned to March 17, to be heard at Forster.
In arguing that Mr Cody should have his bail extended in relation to the aggravated break and enter, his lawyer Nicola Breward pointed out he needed to be “at liberty” to prepare his case in relation to these previous matters:
- Be carried in conveyance taken w/o consent of owner
- Two charges of assault officer in execution of duty
- Resist officer in execution of duty
- Goods in personal custody suspected being stolen (m/v)
- Goods in personal custody suspected being stolen (not m/v)
Ms Breward told the court her client was a young Indigenous man who had recently enrolled in a music course at Byron Bay and had never been in custody before.
Magistrate Ian Rodgers agreed to extend Mr Cody’s bail but tightened the conditions which include abstaining from drugs and alcohol and to undergo regular testing.
He must also report to the Coffs Harbour police station every Monday, Wednesday and Friday and abide by a curfew.
Monday, January 31, was a busy day in court for Mr Rodgers, who had 99 matters listed.
In the afternoon he asked if anybody was willing to have their matter adjourned.
A number of people took him up on the offer.
