David Carter Ney on drug and weapons charges at Coffs Harbour Court

A young man has been released on bail in the lead up to the anniversary of his brother’s suicide. His mother wept as the details were revealed in a Coffs Harbour court.

A young man who allegedly had weapons despite being specifically prohibited to do so, has been released on bail after being arrested west of Coffs Harbour.

David Carter Ney appeared in custody before Coffs Harbour Local Court on Tuesday, February 22, on four weapons charges and one charge of possessing marijuana.

Among the weapons allegedly found at his home in Karangi, was a set of replica “toy” handcuffs that could be easily released, the court heard.

The location they were found - in a bedside table - was considered by Magistrate Ian Rodgers when determining bail.

Mr Rodgers also took into account the suicide of Mr Ney’s brother and that it was coming up to the one year anniversary of the tragic event.

Mr Ney’s lawyer said “custody would be very onerous at this time without bail”.

The court heard Mr Ney suffered depression and anxiety and was on medication to address it.

His mother wept as the details were revealed and she was comforted by Mr Ney’s partner who was also in court to support him.

The court also heard that the 27-year-old had been on a weapons prohibition order since March 2019.

Mr Rodgers granted bail on the condition Mr Ney stay at his mother’s place in Karangi and report to the Coffs Harbour police station between 8am and 9pm every Monday, Wednesday and Friday.

The matter was adjourned to March 14 when Mr Ney will face two charges of possess or use a prohibited weapon without permit, two charges of use prohibited weapon contrary to prohibition order and one charge of possess prohibited drug.
