A farmer who unleashed vile abuse at his ex’s new partner and a neighbour, including threats to cut ears off, has narrowly avoided jail.

Dain Anthony Mavin, 41, appeared at Coffs Harbour Local Court for sentencing after pleading guilty to three counts of stalk/intimidate intend fear physical etc harm, dangerous/reckless driving and not give particulars to another driver.

One of the offences relate to hundreds of abusive messages Mavin sent to his ex’s new partner in March 2021.

“I’ll hunt you, I’ll take notice of ya f**ked up head and take it off,” Mavin said, according to court documents.

The court heard a texting war took place over an extended period, which included death threats by the farmer.

“I’m gonna rip ya f**king head off. I have 120 hungry pigs c**t do ya homework im not scared of ya i’ll dismember you and ya head on a holden and my pigs will do the rest,” Mavin wrote.

He then launched into cannibalistic threats.

“I’ll chop your ears off. Then eat em. I make salami,” he wrote.

Over two days in March, Mavin sent a further 43 text messages and called the victim 21 times late at night.

Facts state the victim was worried the farmer would carry out his threats.

Mavin was arrested last June and told police: “I didn’t send any messages that would’ve incriminated me”.

In an unrelated incident in December 2020, Mavin was involved in a road rage incident.

He started beeping and yelling at a hatchback driver from his Holden Rodeo at Red Rock.

The victim then followed Mavin to find out why he was carrying on.

When the pair stopped at a boat ramp, Mavin continued to yell and honk before “bunny-hopping” his car toward the victim.

Facts state he rammed the victim’s car – pushing it back – before driving toward the victim.

The victim threw himself out of the way as Mavin drove off.

He court heard it was an impulsive, aggressive and unwarranted act, which the victim described as “traumatic”.

Mavin was also sentenced for a barrage of abusive texts to his neighbour in May, in which he threatened to bite their ear off and made bizarre sexual threats.

“You’re a sl*t, I’m going to cave your head in and (ejaculate) on it,” he wrote.

He called her more than 100 times as sent up to 30 text messages, threatening to drive his car through her home,

When police attempted to arrest hi, Mavin bolted through his backyard before handing himself in a few days later.

The court heard Mavin had a history of domestic violence offences – and in some cases was a victim.

Magistrate Paul McMahon said he lacked the emotional resources to deal with problems.

The court heard he engaged with anger management and was working to address issues.

His lawyer Hugo Schleiger argued sending him to jail would hinder the progress he had made.

Mr McMahon noted the abusive messages sent didn’t physically harm his victims but caused emotional and psychological distress, which was “arguably more problematic”.

Mavin was sentenced to a 12-month intensive correction order, which is a prison sentence served in the community, and 100 hours community service.

“It was touch and go as to what I was going to do. In your favour, you appear to be addressing the issues,” Mr McMahon said. “If you continue the way you were, you’ll end up in prison. Don’t tempt fate.”
