Coffs Harbour court hears accused arsonist has an alibi

If found guilty the accused could face up to 14 years in jail. A front patio was allegedly set alight during the incident.

A Coffs Harbour man accused of setting a home on fire and telling the occupants he was going to “get them” has denied the allegations, claiming through his lawyer in court that he has an alibi.

Leyland Douglas Roberts, who has been charged with two counts of damaging property by fire with the intent to injure, appeared on screen in Coffs Harbour Local Court where he attempted to make a bid for bail.

He had been remanded in custody since his arrest on July 25, when the alleged arson offences took place. If found guilty and convicted he could face up to 14 years jail time, the court heard.

Police alleged Mr Roberts went to the home of a man and his mother, both known to him, and a disagreement led to the male victim closing the door and Mr Roberts yelling.

It is alleged the victim then realised the tarp on his patio was in flames.

The court heard the victim came outside and allegedly heard Mr Roberts say “I’ll burn youse (sic) out”. The victim used a garden house to put out the fire but then realised there were flames outside his front door, with Mr Roberts having allegedly lit the timber table on fire.

Police were called and they arrested him on the eastern side of the complex, the court heard.

But despite the prosecution claiming they had a strong case, Mr Roberts’ lawyer told the court that he intended to plead not guilty and had an alibi.

In arguing for his bail, they said Mr Roberts had taken steps to address his alcohol and drug issues and would be able to live with a family member in Toormina.

But Magistrate Rodgers pointed out Mr Roberts’ lengthy criminal history which included DV offences, and refused bail.

He said the case against him appeared to be “strong” and he would serve a full time custodial sentence if convicted.
