Lumberjack caught short after moving ute from property

A tree logger with a sorry driving history has been felled in court after being asked to move a ute from a friend’s property.

Jesse Wayne Noel Irvine, 35, of Kempsey, was waved over by police at a random breath stop on Giinagay Way at Macksville mid-afternoon on April 18.

Irvine couldn’t produce a driver’s licence and police checks revealed it had expired on January 3 and then been formally suspended due to accumulation of demerit points.

The Navara he was driving was also unregistered.

Irvine’s lawyer said his client worked as a logger at Congarinni North, and without a licence would either have to camp there or rely on friends to get to his job.

At Macksville Local Court on Thursday, magistrate Nash said Irvine’s recent poor driving history was concerning and “growing”.

Mr Nash said Irvine should be getting sick of working hard and using his money to pay fines.

“If you don’t have a licence you can’t drive,” Mr Nash said.

Irvine was fined $440 and disqualified for six months for drive while licence refused, second offence.
