Jak William McBean in Coffs Harbour court after alleged AVO breach

A Coffs Harbour teenager accused of “serious” domestic violence offences came before the same magistrate twice in the space of a day - and second-time round was refused bail. See why.

Jak William McBean was granted bail on Tuesday, and refused a day later after allegedly sending messages on social media.

A young Coffs Harbour man is in custody after allegedly breaching a freshly minted apprehended violence order (AVO) by reaching out to family and a friend of the complainant.

Jak William McBean, 18, appeared in the dock of Coffs Harbour Local Court on Wednesday when he faced the same magistrate who had granted him bail the day before - Peter Barnett.

The Boambee East teen faces a string of domestic violence-related charges and was served with an AVO for the protection of the alleged victim at 5.30am on October 3.

McBean appeared in court that day when Mr Barnett granted him bail, but later that night police allege he contacted a relative of the complainant on Facebook Messenger: “Hey I know I shouldn’t be reaching out to you but ... I’ve just been balling my eyes out”, court documents state.

The man then allegedly sent a message through Instagram to a friend of the complainant.

McBean’s lawyer Jason Hatch told the court one of the messages was apparently sent before his client was first arrested - but the phone was out of data and when recharged, only then did it send.

McBean was granted bail on Tuesday, but refused on Wednesday when he came before the same magistrate when additional matters were raised.

Magistrate Barnett wasn’t convinced, claiming McBean may as well have “blown a raspberry” at the court when first granted bail.

“How much more blatant can you get,” Mr Barnett said.

“This is a man who’s charged with serious domestic violence offences.”

McBean is facing a number of charges relating to alleged events on September 27 and October 2, including stalk/intimidate, assault occasioning actual bodily harm, intentionally choke etc person with recklessness and drive motor vehicle during disqualification period.

No pleas have been entered.

Police prosecutor Heidi Warren opposed bail out of concerns for the protection of the alleged victim.

Mr Barnett said McBean’s alleged messages through social media regarding his “fragile condition” smacked of controlling behaviour.

He refused bail and adjourned the matter to October 10.

“Off you go, young man,” he told McBean.
