Faridoon Khaksar Coffs Harbour car park rapist sentenced in court

A court has heard shocking details of a traumatic sexual assault of a teen after she was led from a dancefloor - for which a man has been spared any further jail time. WARNING: GRAPHIC.

A convicted rapist will be allowed to return to Coffs Harbour - the “only hometown he has ever known” – despite the horrific nature of an assault he committed against a teenaged woman.

The long running case of Faridoon Khaksar has been resolved in the Coffs Harbour District Court with Judge Michael McHugh ruling on Friday the 22 months he spent remanded in custody was sufficient punishment for the rape and two incidences of sexual assault in the back of his car near the Coast Hotel in early 2022.

On Tuesday he was formally sentenced with Judge McHugh saying he was bound to consider Khaksar’s “deprived background” in war-torn Pakistan where his father, who was in the army, had a leg blown off.

His father was violent towards his mother, beating her with the metal sticks he used to walk with, and that bombings were a daily occurrence Mr McHugh said.

After one bombing Khaksar recalled “legs, heads, arms on the street and blood everywhere”, Judge McHugh said.

Khaksar came to Australia in 2014 and later settled in Coffs Harbour, playing soccer and pursuing his education.

In arguing he should be able to return to town, his lawyer told the court on Tuesday that Coffs was “the only hometown he has ever known” and that his two brothers live here.

Judge McHugh allowed this, but imposed a two-year apprehended violence order with the condition he not approach the victim.

“If you see the victim anywhere, you turn the other way and walk away,” he told Khaksar.

It was heard in court that Khaksar and the victim had been dancing at the Coast Hotel nightclub and he had put his hands around her waist and they had both been drinking alcohol.

CCTV from the night showed her stumble as they walked down the stairs and as they made their way out the back and into his car she asked “where are we going?”.

Details of the charge of sexual intercourse without consent – to which he eventually pleaded guilty in November last year after denying it for more than two years – and the two other matters taken into account were outlined in court.

After leading her away from the dance floor and into the front seat of his silver sedan, Khaksar drove his victim a short distance to a nearby carpark and got out, asking her to get in the back seat which she did, Judge McHugh said.

He then put his hand on her head and forced her to perform fellatio before putting his hand up her skirt and pulling her pants down and raping her.

This lasted for about four minutes and he ejaculated inside her, Judge McHugh said.

While this was happening a friend had tried to call her and when it was over she texted saying “I can’t call because I’m in a dude’s car, I don’t know how I got here, I think I just got raped”.

When Khaksar took her back to the vicinity of the hotel she spoke to her friends, broke down in tears and police were called, who instructed her to go to the Coffs Harbour hospital for examination.

She was also breath tested and blew 0.076, Mr McHugh said.

Samples were taken from the victim and found to match Khaksar’s DNA following his arrest at Coffs Harbour TAFE campus on September 22, 2022.

Due to time already served and various discounts for his guilty plea, challenging upbringing and no prior offending, his non-parole sentence of one year, 10 months and 20 days expired on Tuesday meaning he was immediately released to parole to be of good behaviour and abide by the AVO for two years.
