COFFS Harbour City Council is waiting for judgment on its legal challenge to the approval granted for a 200-lot subdivision between Sandy Beach and Hearnes Lake.
The council is fighting to restrict subdivision on the low-lying coastal site to a much smaller number of lots.
The NSW Land and Environment Court this week finished hearing the case surrounding the council’s challenge to the validity of the concept approval issued to Sydney NSW Property Developments Pty Ltd at Hearnes Lake by former NSW planning minister Tony Kelly in December 2010.
The hearing ran from Tuesday to Thursday this week.
The judge reserved his decision for a later date and Coffs Harbour City Council will now wait for that judgment.
All parties have been given further opportunity to make written submissions next week about how recent changes to Part 3A of the Environmental Planning and Assessment Act 1979 might affect the outcome of the case, but Coffs Harbour City Council has not yet tipped its hand as to whether it will be making a submission.
