A seasonal farm worker accused of raping a teenage girl at a Coffs Coast beach has denied all charges and argues “we both agreed to do it on that night ”.
Agaalofa Agaalofa, 26, has been remanded in custody at Kempsey jail since his arrest in January this year.
NSW Police initially arrested the wrong man following the alleged sex attack about 7.30pm on November 10, 2023 at Arrawarra – a picturesque coastal village about 33km, or 30 minutes drive, north of Coffs.
Agaalofa was in the Coffs area at the time of the alleged offending as part of the Pacific Australia Labour Mobility (PALM) scheme. He was residing in a camp with fellow agricultural workers.
Agaalofa appeared before Judge Michael McHugh in Coffs Harbour District Court on Monday over video link from Mid North Coast Correctional Centre at Kempsey.
Through a Samoan interpreter, Agaalofa was asked to enter pleas to four charges of sexual intercourse without consent, as well as one charge of common assault.
While responding to the first listed charge of sexual intercourse without consent, Agaalofa told the court “we both agreed to do it on that night, I didn’t force her”.
The judge advised Agaalofa the arraignment process was to enter either a guilty or not-guilty plea. Agaalofa then responded “not guilty” to each charge.
The case has been adjourned to November 25, when a trial date is due to be set.
It is estimated the trial will take seven days.
