A major residential subdivision proposed for West Byron will be contested in a three day hearing before the Land and Environment Court this week
Byron Shire Council will contest the developer’s appeal, which came after the proposed $40 million development was refused by the Northern Regional Planning Panel more than two years ago.

A three day hearing to consider an appeal related to a major residential subdivision proposed for West Byron will begin today.
Developer Site R & D lodged an appeal with the Land and Environment Court after the Northern Regional Planning Panel refused its development application for a $40 million subdivision including 387 lots in February, 2019.
While the five-member panel refused the DA, is it Byron Shire Council contesting the appeal against the developer.
It is understood an amended DA lodged in August 2019 sought approval for just 162 lots.
The hearing is expected to run until Wednesday.
The Site R & D, which involves land within the West Byron Urban Release Area off Ewingsdale Road, is separate to an adjacent development which has been approved, subject to conditions, by the Land and Environment Court.
