Bikie Ahmad Doudar fails in $2m bail bid over Mick Hawi murder

A Lone Wolf bikie accused of masterminding former Comanchero boss Mick Hawi’s murder outside a Sydney gym has lost his multimillion-dollar bid for bail, with a judge slamming his “flagrant disregard” for the law.

After eight months in custody, Ahmad “Adam” Doudar applied for release last Friday with a $2 million surety put forward by a relative of a man named in the police investigation.

Justice Peter Garling denied the 38-year-old bail in the Supreme Court on Wednesday due to his lengthy criminal history, his “flagrant disregard” for the law and the way he’s flouted parole in the past.

“There is a very real risk which cannot be mitigated that if the applicant is released on bail he’ll commit further serious offences or else endanger members of the community,” he said.

Justice Garling said the Crown case against Doudar was “reasonably strong”.

Hawi was shot at Fitness First Rockdale last February in what the judge described as a “planned execution” over a commercial dispute.

Police allege that 11 days before the brazen daylight killing, Doudar visited jailed high-ranking bikie Hassan “Faks” Fakhreddine, who said he should become involved in the “resolution of a debt dispute between the deceased, Mr Hawi, and some property developers”, Justice Garling said.

The Crown alleges Doudar and Fakhreddine met up again in prison shortly after Hawi died, the court heard.

Police have been investigating whether a wealthy construction industry figure was being hassled to cough up $300,000 to Hawi at the time of his death, having already paid the former Comanchero boss $200,000.

Three men have been charged with Hawi’s murder.

Doudar is accused of co-ordinating it while Yusuf Guney Nazlioglu, another Lone Wolf associate, was the alleged gunman.

Jamal El Jaidi, 31, is accused of driving the getaway vehicle.

Moustafa Salami has been charged with accessory after the fact to murder.

Justice Garling said the murder involved significant planning and sophisticated attempts to conceal the involvement of perpetrators and cars used.

“The murder was committed in the middle of the day, in a public place,” he said.

The court heard Doudar has served a long stint for commercial drug supply and has been convicted of maliciously inflicting grievous bodily harm, break and enter with intent to steal and firing a firearm in a public place.

His parole has been revoked at least twice while he’s also had violent charges dismissed under mental health grounds.

During the bail hearing, Doudar’s barrister Gregory James QC said Sam Hussein Fakhreddine had provided a proposed surety in the form of houses in Arncliffe.

The Crown prosecutor said: “This is the brother of a man named in the Crown case statement”.

Hassan Fakhreddine has not been charged with anything relating to Hawi’s murder.

The court heard Mr Hussein Fakhreddine had been found guilty of common assault years ago — the only thing on his criminal record.

Mr James said the prosecution case was circumstantial, “weak”, and there would be a lengthy delay where his client could spent two years behind bars waiting for trial.

He said CCTV footage which police allege shows Doudar driving between where he lived in Sydney’s CBD and and Kogarah was not clear and “doesn’t rise to the height in proving he was the principal at arranging the assassination”.

The judge agreed the security tape was captured from some distance but said it formed part of the overall circumstantial case against Doudar.

Doudar’s efforts to conceal and repair a car used in the murder are among other pieces of evidence tying him to the killing, prosecutors allege.

Doudar’s case is next due to come before Central Local Court on Thursday.
